Welcome to Road Resolve! These Terms of Service ("Terms") govern your use of the Road Resolve website located at RoadResolve.com (the "Site") and the services provided therein (collectively, the "Services"). Please read these Terms carefully before using our Services.
By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services.
1. Description of Service
Road Resolve provides an AI-powered preliminary diagnostic tool for vehicle issues and a local mechanic locator service. The information provided by our AI diagnostic tool is for informational and educational purposes only and is based on the data you provide and patterns learned by the AI model. The mechanic locator service uses publicly available data to suggest local repair shops.
Our Services are not a substitute for professional advice from a certified automotive mechanic.
2. User Responsibilities
- You agree to provide accurate and complete information when using our Services (e.g., vehicle details, problem description).
- You are responsible for any decisions you make based on the information provided by our Services.
- You agree to use our Services only for lawful purposes and in accordance with these Terms.
- You acknowledge that the AI diagnosis is preliminary and that a physical inspection by a qualified mechanic is necessary for an accurate diagnosis and repair plan.
3. Intellectual Property
The Site and its original content (excluding information provided by users or sourced from third-party APIs like NHTSA or Google Places), features, and functionality are and will remain the exclusive property of Road Resolve and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Road Resolve.
4. Third-Party Services and Links
Our Services rely on third-party APIs, including OpenAI for AI diagnostics, Google Maps Platform APIs (Geocoding and Places) for mechanic location services, and the NHTSA API for vehicle data. Your use of these underlying third-party services may be subject to their respective terms of service and privacy policies. We are not responsible for the practices, content, or availability of these third-party services.
Our Site may contain links to third-party websites or services that are not owned or controlled by Road Resolve. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.
5. Disclaimers
OUR SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. ROAD RESOLVE MAKES NO WARRANTIES, EXPRESSED OR IMPLIED, AND HEREBY DISCLAIMS AND NEGATES ALL OTHER WARRANTIES INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT OF INTELLECTUAL PROPERTY OR OTHER VIOLATION OF RIGHTS.
ROAD RESOLVE DOES NOT WARRANT OR MAKE ANY REPRESENTATIONS CONCERNING THE ACCURACY, LIKELY RESULTS, COMPLETENESS, OR RELIABILITY OF THE USE OF THE DIAGNOSTIC INFORMATION OR MECHANIC SUGGESTIONS PROVIDED THROUGH THE SERVICES OR OTHERWISE RELATING TO SUCH MATERIALS OR ON ANY SITES LINKED TO THIS SITE. THE AI DIAGNOSIS IS PRELIMINARY AND FOR INFORMATIONAL PURPOSES ONLY. ALWAYS CONSULT A QUALIFIED MECHANIC FOR ACCURATE VEHICLE DIAGNOSIS AND REPAIR.
WE ARE NOT RESPONSIBLE FOR THE QUALITY, SAFETY, OR LEGALITY OF SERVICES PROVIDED BY ANY MECHANICS LISTED OR SUGGESTED THROUGH OUR SERVICE. ANY TRANSACTIONS OR INTERACTIONS YOU HAVE WITH MECHANICS ARE SOLELY BETWEEN YOU AND THE MECHANIC.
6. Limitation of Liability
IN NO EVENT SHALL ROAD RESOLVE OR ITS SUPPLIERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (III) ANY CONTENT OBTAINED FROM THE SERVICE; AND (IV) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.
OUR MAXIMUM AGGREGATE LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATING TO THE SERVICES SHALL BE LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICES IN THE 12 MONTHS PRIOR TO THE CLAIM (IF ANY) OR (B) ONE HUNDRED CANADIAN DOLLARS ($100 CAD).
7. Indemnification
You agree to defend, indemnify and hold harmless Road Resolve and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, or b) a breach of these Terms.
8. Modification of Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.
9. Governing Law
These Terms shall be governed and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to its conflict of law provisions.
